ICT Law and Regulation
Pacific Legal Network PNG has been at the forefront of the PNG ICT industry since before competition was introduced in 2007. We have had direct involvement in all legal and regulatory aspects of the PNG ICT industry, including:

The review and formulation of the PNG Government’s National ICT Policy which resulted in the liberalisation of the ICT regime and creation of a new independent ICT regulator;

Assisting with the review and enactment of the National Information and Communications Technology Act 2009 and related subordinate laws, including regulations on operator licensing, spectrum, cybercrime, universal access and SIM Registration;

Assisting mobile operators, ISP’s, Pay & FTA Television providers and other ICT businesses enter and operate in PNG (via both greenfield rollouts and acquisitions);

Advising ICT businesses on financing and refinancing of their operations via debt and/or equity;

Assisting with the establishment of a mobile financial services business, mobile insurance business, mobile electricity payment service and other value added services;

Negotiating and drafting interconnection, collocation and other wholesale access agreements;

Negotiating and drafting operational agreements, such as equipment supply contracts, master distribution and reseller agreements, branding and sponsorship agreements, corporate and consumer service agreements and site security and lease agreements;

Providing updates on legal and regulatory developments affecting the PNG ICT industry and general legal and regulatory advice regarding ICT matters.
